We provide dedicated software development squads, project managers, and digital engineering services through www.cloudesk.work (the "Service"). This Privacy Policy outlines how we collect, handle, safeguard, and protect your information, project repositories, files, and intellectual property across international jurisdictions.

2. Client Data & Code Security (NDA Guarantee)

As a dedicated engineering partner, we handle sensitive client codebases, architectures, and business logic under strict Non-Disclosure Agreement (NDA) safeguards:

  • Source Code Confidentiality: Your source code, API keys, database credentials, and proprietary algorithms remain strictly confidential. Access is restricted exclusively to assigned engineers and your dedicated Project Manager on a least-privilege, need-to-know basis.
  • Google Drive & Attachment Security: Any documents, specifications, or media shared via Google Drive or platform attachments are encrypted in transit and at rest, and used solely for the execution of your assigned sprints.
  • Zero External AI Model Training: Cloudesk guarantees that your proprietary code, business logic, and project briefs are NEVER ingested, sold, or used to train public third-party large language models (LLMs).
  • Staging Data Isolation: Staging preview environments created during the 7-day trial or active sprints are isolated behind secure subdomains and access controls. If an account is terminated, staging environments are securely scrubbed.

3. Information We Collect

We collect essential operational information necessary to provide our service:

  • Account & Contact Data: Name, work email address, company name, and communication preferences provided during signup, onboarding, or lead capture.
  • Project Specifications & Backlog: Task briefs, Figma links, Git repository URLs, and user stories shared with your dedicated Project Manager.
  • Billing & Transaction Details: Payment tokens and invoice records processed securely via PCI-DSS compliant third-party processors (e.g., Razorpay, Stripe). Cloudesk does not store raw credit card numbers.
  • Technical Usage Logs: IP addresses, browser types, session activity, and timestamped audit trails for security and dispute verification.

4. Third-Party Integrations

We partner with verified, enterprise-grade infrastructure providers to deliver our service:

  • AWS / Cloud Hosting: Secure staging deployments and server infrastructure.
  • Google Cloud & Drive: Workspace collaboration and file asset storage.
  • Telegram Bot API: Real-time operational lead dispatch and PM notifications.
  • Google Analytics: Aggregated anonymous site traffic analysis.

5. Regional Privacy & Cross-Border Governance

Cloudesk operates engineering and project management centers in India with global client bases across the United States, United Kingdom, European Union, Australia, and Canada:

5.1 United States Privacy Disclosures (CCPA, CPRA & CalOPPA)

  • Non-Sale of Personal Data: Cloudesk does not sell, lease, rent, or share personal information or proprietary code with third parties for commercial monetary or marketing purposes.

5.2 United Kingdom & European Union (UK GDPR & EU GDPR)

  • Lawful Basis for Processing: We process account and project data primarily pursuant to Article 6(1)(b) of the GDPR (performance of a contract to deliver software engineering and project management services).
  • International Data Transfers: Cross-border data transfers to our delivery centers in India are safeguarded by Standard Contractual Clauses (SCCs) and the UK International Data Transfer Addendum, ensuring technical and organizational protection comparable to GDPR standards.
  • Data Subject Rights: European clients maintain rights to access, rectification, erasure, data portability, and restriction of processing under applicable law.

5.3 Australia (Privacy Act 1988 (Cth) & Australian Privacy Principles)

🇦🇺 AUSTRALIAN PRIVACY PRINCIPLES (APP 8) COMPLIANCE:

Cloudesk complies with the Privacy Act 1988 (Cth) and the 13 Australian Privacy Principles (APPs).

Under APP 8 (Cross-Border Disclosure of Personal Information), before personal information is disclosed to overseas recipients (specifically Cloudesk engineering and management personnel in India), Cloudesk takes all reasonable steps to ensure that the overseas recipient does not breach the Australian Privacy Principles in relation to that information.

6. Data Retention & Deletion

We retain client account data and project archives only for the duration of the active subscription and statutory accounting periods. Upon written request or account closure, proprietary staging instances, test credentials, and inactive files are securely deleted within 30 days.
